Gotrade Refer-a-friend Promotion
Terms and Conditions
Gotrade Securities Inc (“Gotrade”), is offering you the opportunity to participate in the Gotrade Client Referral Promotion (“Promotion”). By participating in this Promotion, you agree to be bound by the terms and conditions (the “Terms”) of this Promotion and any such variation.
An existing Gotrade client with a funded trading account (“Existing Client”) who successfully refers a new Gotrade client who makes a deposit (“Referred Client”) will be rewarded in accordance with clause 5 below.
This Promotion applies to individuals only. Individuals not eligible to participate as an Existing Client in this Promotion include:
a. Prior Gotrade clients (which includes closed accounts or accounts that have been suspended, cancelled, restricted or terminated);
b. Gotrade employees and their immediate family members;
c. Clients who have not fulfilled minimum funding requirements or have a zero balance in their trading account at the time of making the referral;
d. The spouse of the Existing Client.
The following requirements must be satisfied for the Existing Client and Referred Client to be eligible for this Promotion:
a. The Existing Client’s referee successfully opens a Gotrade trading account in his/her own name, where such client is not already an existing client of Gotrade. For the avoidance of doubt, Gotrade has sole and absolute discretion to approve or reject any application without giving any reason, notice or assuming any liability to any person;
b. The Existing Client’s referee meets all applicable Gotrade onboarding requirements, including, but not limited to, Gotrade’s know your customer (KYC) and anti-money laundering (AML) requirements; Under this Promotion, an Existing Client may not refer the same Referred Client to open multiple accounts;
c. Under this Promotion, an Existing Client may not refer more than 25 Referred Clients.
A Referred Client will receive US$2.00 in cash and the Existing Client shall receive up to US$100 per Referred Client in free stock (or cash). For Existing Clients, stock rewards are chosen randomly from a list of stocks, which vary in value between US$1 and US$100. For the Existing Client, rewards must be claimed within 60 days through the Gotrade platform, or the reward will be forfeited.
In making a stock reward, Gotrade is not obliged to determine suitability of the stock awarded under this Promotion. Stocks rewarded may be liquidated as soon as they are received. Neither receipt of stock through this Promotion, nor identification of a particular stock in communications related to this Promotion constitutes a solicitation of the stock, or recommendation to buy, sell, or hold the security, or investment advice. If you do not feel that the Promotion is suitable for you, you may choose not to participate in this Promotion.
Upon satisfying the requirements for the Promotion in these Terms:
a. Following Gotrade’s approval of the Referred Client’s account, Gotrade will credit the Existing Client’s trading accounts no later than 3 business days after the submission by the Existing Client;
b. Both the Existing Client and the Referred Client will also be subject to all the Gotrade account terms and conditions, found here: https://www.heygotrade.com/legal; in particular, the terms relating to rewards found at clause 22.
Gotrade reserves the right, and has sole discretion, to prohibit any Existing Client / Referred Client from participating in any aspect of the Promotion if Gotrade deems or suspects that any Existing Client / Referred Client has engaged in or has attempted to engage in any of the following:
a. acting in violation of these Terms;
b. damaging, tampering with or corrupting the operation of the Promotion;
c. an activity deemed in the sole discretion of Gotrade to be generally inconsistent with the intended operation of the Promotion.
If any Existing Client / Referred Client is discovered to be ineligible for the Promotion for any reason, Gotrade is entitled to, at any time:
a. forfeit, withdraw or withhold the payment amount(s); or
b. where the Promotion has been awarded and/or utilised, Gotrade may reclaim and/or deduct the payment amount(s) from the Existing Client’s and/or Referred Client’s account.
In such an event, no person shall be entitled to any payment or compensation from Gotrade.
Participants of the Promotion may not be eligible to participate in any other ongoing promotions by Gotrade, unless otherwise permitted by Gotrade.
Gotrade has sole discretion to determine cases of suspected abuse, fraud, or breach of these Terms. Gotrade’s decision shall be final and shall not be obliged to provide reasons for the same.
Participants of the Promotion acknowledge and agree that they are prohibited from acting as a salesperson, representative or affiliate of Gotrade in any manner.
Participants of the Promotion shall conduct activities in compliance with applicable law, and unless registered as required under any securities laws, shall not conduct any activities that require such registration, including registration as a broker-dealer or investment adviser.
Gotrade may, at its discretion, vary, amend, delete and / or add on to any of these Terms, including, but not limited to, terminating this Promotion at any time without giving any reason or prior notice or assuming any liability to any Existing Client(s) / Referred Client(s), and all Existing Clients / Referred Clients shall be bound by such variations, amendments, deletions and / or additions. Gotrade shall not be obliged to give any reason or enter into any correspondence with any person on any matter concerning this Promotion. This Promotion may not be open to all clients in all jurisdictions.
Gotrade shall not assume any liability for any loss incurred or suffered by any person in connection with the Promotion, howsoever arising, including without limitation, any error in computing trades and trade commissions, and any subsequent changes to commission prices. Trading in financial instruments carries various risks and is not suitable for all investors. It is possible to lose more than your initial investment.
These Terms should be read in conjunction with the terms and conditions, general disclosures and all other terms, policies and disclosures available at https://www.heygotrade.com/legal. In the event of any inconsistency between these Terms and any brochure, marketing or promotional material relating to the Promotion, these Terms shall prevail.
These Terms shall be governed by the laws of Malaysia and any dispute arising in relation to these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
